When selling a property, it is the responsibility of the purchaser, not the vendor, to replace/repair the fosse if it has failed its inspection.  This should be carried out within one year.

Naturally, a reduction in the price of the property may be negotiated but, surely, this will be better than attempting to claim against CGT?

I would have thought this was suspiciously like maintenance to keep the property up to standard, rather than improvement. The problem being that if you buy/sell a property where the septic tank is not conforme, it would be normal to negotiate a corresponding reduction in the price. Bringing the fosse up to normes would simply bring the property back up to its proper value, rather than actually adding value. But you can always try it and see what your notaire says.
