Definitely talk to your Maire. There may be an equitable solution where you provide the kerb and the commune contractors install it. We had a similar problem where a ditch was required along the length of our garden and a pipe needed under the drive. We bought the pipe and gravel and the contractors installed them and dug the ditch.

hi 'duck'man..... I'm having difficulty imagining why you seem to want to divert (road)water through your private garden to a source(?), which leads me to think that if water naturally wells up there then the substrate is already saturated.  Why is there no ditch or fosse to take run-off from the road towards communal drains alongside the road without going into your drains?   Take photos and enquire at the Mairie without volunteering to evacuate their drainwater, as this winter's rainfall is by no means exceptional and you could be inviting worse problemsin the future.

Ask you Maire. A couple of years ago our ex- Maire actually came to see us to say he had noticed the water on the road outside our house which was flooding onto our land and suggested we ring the people responsible for roads in our commune, he gave me the number and told us what to tell themI rang, they were at our house within the hour and looked at the situation. 6 months later they arrived to do the necessary work.

We wanted to improve out driveway between the gates and the edge of the tarmac road, about a metre, to stop it churning up into mud in the winter courtesy of the postie's van. So we asked the maire if it would be ok to concrete it - and got a lecture on how the commune owned the land 1 metre from the edge of the road etc etc - Non!

However if the road is draining onto your land and causing problems it's worth asking- take some photo's?
